Australia Immigration Process And Programs

Australian Immigration Programs address the need of every aspirant immigrants. They have made available immigration pathways to aid skilled professionals who want to work in Urban Australia and also those who want to work in regional Australia. The pathways also address the needs of investor immigrants to identify where they would want to invest and plan accordingly. There are pathways designed for elderly people to ease their entry into Australia.

These programs are very convenient to understand and follow. The steps are simple and don’t involve too many hurdles to cross. 

Most priority programs, for either Skilled Professionals or Business investors, requires the immigrant aspirant to submit an expression of Interest through Australia’s Skill Select Portal online. Expression of Interest is not a VISA application. Based on the information in your Expression of Interest, your skills will be assessed and points will be allocated. The score decides whether the applicant will be able to proceed further or otherwise.

Such profiles irrespective of the score, will be in the Skill Select portal for a maximum of 2 years, during which period, the applicant can access his/her EOI, update more information related to experience, education, family, language or enhance his score, or proceed with the process as would be the case.

However, under the below circumstances, the EOI would be removed from the SkillSelect Portal-

i. The applicant has received two invitations to apply but has failed to respond to either of them, the case will be deemed uninterested and removed from the portal

ii. The applicant has received an invitation, subsequently applied successfully for the same and has received the permanent or provisional Visa as would be the case.

 

After Expression of Interest-

Scenario 1- The applicant has received an invitation or has been selected-

1. If selected, Skill Select sends an invitation to the applicant to apply for the relevant Visa.

2. Such an applicant will have 60 days’ time to apply for the VISA. No application beyond the stipulated timeframe will be accepted.

3. IF there is any situation where you haven’t been able to send the application with the time, then your profile will continue to be in the Skill Select until you receive your second invitation or up to 2 years from the date of submission.

Scenario 2- The applicant hasn’t received any invitation or has not been selected-

1. Expression of Interest is not an application neither does it promise your Visa confirmation. In a case where the profile doesn’t receive any kind of invitation, such profile will remain in the Skill Select portal for a maximum of 2 years

2. During the 2 years, the applicant, can access his EOI and update the profile as would need be. However, if there are any misrepresentations or mismatch between the EOI and the supporting documents, chances are that the profile could get rejected for a lifetime.

Most Visa Programs are either Permanent Resident Programs or Provisional Visa Schemes.

 

Australian Skilled Professional Visas-

1. Skilled professional migrant aspirants looking to migrate to Australia and have no job offer nor any kind of sponsorship/nomination from either employer in Australia or relatives can apply through the Skilled Independent Visa ProgramThis program/pathway is based on points and the applicant is expected to have a minimum of 65 points

2. to become eligible to receive an invitation to apply for the VISA. These points depend on one’s age, education, professional experience, English language proficiency among others. This is a Permanent Resident Visa Program.

You have a valid nomination from an Australian Government Agency from a particular state or territory, then you become eligible to apply for the Skilled Nominated Visa Program (Sub Class 190). Under this scheme, the applicant will have to reside and work in the same territory/state from where he/she received the nomination form for a minimum of 2 years. Post that they have the liberty to travel where ever they like. It is again a points-based Visa program, which requires the applicant to have a minimum score of 65. This is also a permanent Resident Visa Program.

3. If you are someone wanting to live and work in non-urban places, then Skilled Regional (Provisional) VISA is just for you. This again is a permanent residency visa program with a point system. However, the minimum required score to qualify is 60 points only. If successful, you get to live and work in the regional areas of Australia.

4. An employer with whom you have already worked with or have some kind of rapport or someone who has a need for your skill can nominate you for PR Visa. This scheme is the Employer nomination Visa (Sub Class 186). This does not point system. However, the nomination decides where the applicant will live and work. This is again a Permanent Residence Program.

There are 3 modes by which you can enter Australia under this scheme-

a. The Direct Entry Stream –The eligible applicant with the nomination can simply apply for the PR without any EOI. b. The Agreement Stream – This stream will work for all those employees who get nominated by an employer who is part of the Labour Agreement. 

c. Temporary Residence Transition Stream- Applicants who already have a Temporary Visa to work in Australia, can apply for this stream if nominated by the employer.

5. The Regional Sponsored Migration Scheme is for those skilled workers who have secured a nomination from their employer from rural Australia. This is again a permanent residency program and doesn’t need your profile to be in the Skill Select portal. Again the applicant can apply under either the Direct Entry stream or the Temporary Residence Transition Stream as would be the need.

6. Another pathway, for those who want to explore the waters of Australia, can do so with the Temporary Skills Shortage Visa program. This usually applies to those who are trying to fill in a job vacancy which the locals couldn’t do. This Visa is valid for 2 years of time. However, few schemes under this program, allows the visa holder to convert his visa to a permanent residency visa.

All of these programs need the applicants’ job profile to be part of either long term or short term Skilled Occupational list. 

Just as the Skilled immigration programs, Australia’s investments too garner quite an amount of provisions for the investors. Many streams have been designed to cater to the needs of every investor.

1. If you are someone who can source your venture capital from a member of the Australian Investment Council, then you are eligible to apply under the Venture Capital Entrepreneur Stream (SubClass 132 B). This is again a Permanent Residency Program. The main applicant will spend around AUD 7855 for the VISA, while every additional applicant above 18 years will spend around 3500 AUD and under 18 years will spend around 2000AUD on the VISA Application.

2. If you have been nominated by any of the State or Territory authority of Australia you are qualified to apply under the Investor Stream (188B Visa). This is actually a 4-year temporary visa program. If the investor continues with the investment/holds on to his/her designated investment for the 4 years, then he/she qualifies to apply for Permanent Residency there.

3. Investors who can invest a minimum of AUD $5 million in Australia are eligible for Australian Significant Investor Stream (Sub Class 188). Such investment can be in a running business or a start-up or in any other investment activity in Australia. Post the provision period, the applicant needs to apply for the Permanent Residency under Sub Class 888. A further of 1.5 million AUD needs to be invested in managed approved funds.

4. There is one more Entrepreneur Stream or 188E Visa program which needs that the applicant applies by submitting an Expression of Interest in the Skill Select Portal. This is a 4-year temporary visa program for entrepreneurs with innovative ideas and strong financial backing. Post this 4-year period, if the applicant satisfies all of the norms laid down by the government of Australia, he/she qualifies to apply for Permanent Residency.

5. If you are an investor looking to invest a minimum of AUD 15 million in Australia, then you qualify under PREMIUM INVESTOR VISA stream. Such an investor needs to be nominated by the Australian Trade Commission (AUSTRADE). There are few regulations put in by the Government of Australia in relation to the investments by such Premium investors. This is a Permanent Resident Visa.

Most successful applicants, either Skilled Professionals or Business Investors, eventually (a period of 5-6 years of living in Australia) qualify to apply for Australian Citizenship.
