The custom clearance industry is an ever-growing industry in India. The government of India has been providing many other schemes and incentives for businessmen, as well as new entrepreneurs. The new reforms by the government are also making things easier for these people to start their own customs clearance industry in India. The government of India has also been granting many new tax benefits to people who want to start a custom clearance business in India. These reforms might be described as the Customs House Agents Regulations, 2021.
The first thing that we will discuss in the customs clearance work in India is the need for these people's licenses. This is a very important law for all the people working in this field. If you are not licensed to do the custom house agent work in India, then you are not allowed to do any sort of business involving the import or export to or from the country. This includes all the freight transportation that is done through trucks, ships, and airplanes. It means that if you want to do any kind of import or export to or from the country, then you have to first get the license of the agent from the concerned department.
The second thing about the regulations of the customs clearance agent in India is that the agents cannot directly get into the possession of the goods that they have cleared. They have to have a legal right to inspect the goods that have been cleared. After that, they can enter the possession of the goods that are not cleared and have a right to resell them. But this does not mean that they can directly go and sell these goods to the end-user. They have to first have the approval of the concerned ministry or authorities before they can do so.
Another important regulation is that only those customs officials who actually take care of the clearing house agent have to be licensed. There is no limit as to how many such officials can be licensed. There are only certain examinations for them to clear. These examinations are known as the customs bond exam, examination of documents test, and certification test. Once you clear these tests, you are considered to be an authorized customs clearance official.
The third thing about the customs clearance process is that there is only one commissioner of the department or an assistant commissioner of the department. The person who is actually in charge of the clearance division is called the customs commissioner or assistant commissioner of or deputy commissioner of customs. So when you get customs clearance, you will actually be assigned a special commissioner or assistant commissioner. It is their duty to look after the whole procedure and to give clearances to the shipments that are getting cleared off.
The fourth regulation is that there is a limit within which a shipment cannot be re-closed. This time limit was implemented because there were people who were re-closing shipments within fifteen days of the shipment clearing. This was done in order to protect the interests of the consumers and of the importers and exporters. There was a lot of pressure on these people to close their transactions because they had not been properly informed about the regulations. Hence the sub-regulation was introduced within fifteen days so that the clients of the importers and exporters would not have problems in getting their shipments approved.
