HOLDINGS: [1]-A metal finishing company's practice of providing employees a "combined" 20-minute rest period before or after the meal break supported a claim for failure to provide rest breaks under Lab. Code, § 226.7, because Industrial Welfare Commission (IWC) Wage Order No. 1-2001 required the employer to provide a 10-minute rest break in the middle of the work periods occurring before and after the 30-minute meal break insofar as practicable; [2]-The existence of triable issues as to whether the rest break schedule stated in the wage order was not practicable precluded summary adjudication.

 

Outcome

Affirmed in part, reversed in part and remanded.
