Why Signing and Witnessing Deed Poll Is Needed

To ensure that your name change is legally binding, we will give you a document with instructions on how to execute your Deed Poll and any additional copies. You alone are responsible for making sure the Signing and witnessing deed poll occurs. The process is rather easy, and the fundamental guidelines are in effect.

Who can be a deed poll witness?

·        Your witness must be at least 18 years old if you're British and live in the UK or Northern Ireland.

·        Your witness must be familiar with you and free from any mental impairments.

·        A witness for you must be impartial. Because of this, your witness may be a friend, neighbor, or coworker but not necessarily a family member, a partner, or someone you live with.

·        You must sign your Deed Poll in the presence of your witness.

·        Your Deed Poll might need to be witnessed by an attorney or notary public if you're British and reside overseas (or somewhere other than the UK mainland or Northern Ireland).

·        Consult your embassy if you are a foreign national to learn what is needed in your own nation.

For a deed poll, how many witnesses are required?

Two reliable witnesses are required to carry out a deed poll. Following the selection of your witnesses, have them sign your deed poll in black ink. Allowing your witnesses to read your deed poll prior to their signature is also a good idea so that they are aware of what they are signing. Give us a call if you have any questions about the Signing and witnessing deed poll, and any queries you might have will be answered by our staff. If you are a British national resident who lives in the UK, the witness you select must also be a resident of the UK and be at least 18 years old. They must be independent from you and have known you for a long time and they must be able to identify you by your original name. This simply means that they cannot be a family member, your spouse, or a member of your home.

Additionally, they must be fully mentally competent, which entails being able to make their own decisions free from any mental impairment due to illness or disability. Unless otherwise shown, everyone has full mental capacity by default. After receiving your Deed Poll, you must sign it and have it witnessed. In legal parlance, this is referred to as execution. We will offer you paperwork with instructions on how to complete your Deed Poll and any more copies so that your name change is legally binding.
