Domestic Partnership v Marriage in California: What's the Difference?

Not everyone wants to get married. Such couples have the option to upgrade their relationship status to 'domestic partners' and register their union in California.

Being in a domestic partnership confers various legal and financial benefits of cohabitation to the couple, just like marriage. That said, there are also a few points of difference between the two.

So, let's take a look at domestic partnership vs. marriage in California: What's the difference?

What is a Domestic Partnership?

A domestic partnership is also known as a civil union. It's a romantic relationship between two individuals who share a household and a common life but aren't married. California law describes the domestic partnership as "two individuals who share each other's lives in an intimate and committed relationship of mutual caring."

Similarities Between a Marriage and a Domestic Partnership

Domestic partnership rights are granted at the state and county level. These benefits depend on where both spouses reside. Similarities between a domestic partnership and a marriage include:

●    Access to health insurance

●    Bereavement rights

●    Housing rights

●    Hospital and jail visit rights

●    Parental rights

●    Access to life and accident insurance coverage

●    Alimony

Difference Between Domestic Partnership & Marriage

Domestic partnership isn't recognized at the federal level. This is where it differs from marriage:

●    Social Security Benefits

Upon the death of an individual, their spouse has the right to social security derivatives. This isn't always the case with domestic partners.

●    Taxation

Unlike married couples, domestic partners cannot file taxes jointly at the federal level.

●    Transfer of Assets

Married couples can transfer assets without any hold-ups or tax penalties. Domestic partners will be subject to taxation.
