The PIL filed against the Avinash Bhosale Group, Dismissed by the Bombay High Court

The Bombay High Court rejected the Public Interest Litigation (PIL) petitioned by Rajesh Bajaj and others against Avinash Bhosale group and others on 24th July 2019. It was observed by the Honourable Chief Justice of Bombay Court that some people abuse the PIL and similar laws to take money from other parties. People who are in front to profess support for the causes of the public and society should be of good moral character first, added the Honourable Court. 


In the year 2015, the PIL was filed by Rajesh Khairatilal Bajaj, Rajesh Alias Bobby Bajaj, the residents of Bhosale Nagar, and others against Avinash Bhosale Group's project named Castel Royale Towers.


The case was previously dismissed by the Noble Court in 2016 due to mistakes on the petitioner's side. In the final hearing, the petitioner attempted to justify the mistake by claiming viral sickness and other medical treatments. Based on the circumstances recorded, the Honorable court discovered from the documented record that during the period of defaults, the petitioner was prosecuting a criminal case to trial. The medical certificate presented by the petitioner was later discovered to be a duplicate. In addition, the Honorable High Court had previously learned that another petitioner, Rajesh Bajaj, was disguising himself as a lawyer.


Mr. Amit Bhosale, the Managing Director of Avinash Bhosale Group stated, "We've been treated badly by self-proclaimed RTI activists often, but we've preserved our faith in the courts, and reality has finally triumphed. We are certain that such orders would deter frivolous claims. The RTI Act, as well as other laws like the Public Interest Litigation Act, are frequently used for selfish motives, and this must stop." stated. in response to the verdict.
