1、The basic situation of this dispute:
The Hangzhou Zhenjiang University Sanse Company submit a request to the China Patent Reexamination Board on 29th September, 2016, requesting to invalidation of the invention patent of the company's "Goniophotometer" (Patent No: ZL200710068056.0).
The China Patent Reexamination Board has made No. 31980 "Invalidation Request Examination Decision" on 19th April, 2017, believing the invention patent of "Goniophotometer" don't have any inventive, and decided to declare all the patent rights invalid for this patent.
2、Litigation related to this dispute:
2.1. Patent Introduction
The invention patent "Goniophotometer" (Patent No: ZL200710068056.0) as the Everfine company owned. The company applied to the State Intellectual Property Office for the invention patent of "Goniophotometer on 16th April, 2007", it has approved and awarded invention patent by the State Intellectual Property Office on 4th November, 2009.
2.2. Litigation related to the previous period
The Everfine company sued Hangzhou Zhenjiang University Sanse Company to Hangzhou Intermediate People's Court of Zhejiang Province on 9th August, 2016, requesting Hangzhou Zhenjiang University Sanse Company to immediately stop manufacturing, selling, and promising to sell products that infringe upon the plaintiff's invention patent No. ZL200710068056.0; Semi-finished products and finished products of the infringing products; and compensation for economic losses of RMB 1 million and reasonable expenses of RMB 60,000 for the case, totaling RMB 1.06 million. Currently, the case is under trial.
On September 29, 2016, Zhejiang University Sanse submitted a request to the China Patent Reexamination Board, requesting the patent with the profile number ZL200710068056.0 is invalidated. On April 19, 2017, the China Patent Reexamination Board issued No. 31980 "Review Decision on Request for Invalidation", deeming EVERFINE company invention patent "Goniophotometer" is not inventive, and it is decided to declare the patent right invalid.
